Appeal Rights and Applications for Review

If the applicant and/or owner are aggrieved by a decision of Council, as a result of a condition of approval or by a determination of refusal, there may be a right of review under the provisions of Part 14 of the Planning and Development Act 2005.

An application for review must be lodged with the State Administrative Tribunal, with a copy of the application forwarded to the City. The State Administrative Tribunal contact details can be viewed at the link below.

Note: The Western Australian Planning System does not have any provision for appeals from third parties (i.e. parties other than the owner or applicant).
